Did the suitcase he was seen struggling with contain the body of Ivanice Harris? If so, forensic tests will reveal the truth and Nathaniel Cosby will likely face justice for what he is accused of doing. Otherwise, there doesn't appear to be enough evidence against him to tie him to Ivy's death.
